This privacy policy (“Privacy Policy”, “Policy”) describes the practices of Luminesque Dance Inc. (“Luminesque”, “we,'' “us”, “our”) with respect to our collection, use, storage and disclosure of Personal Information provided to us from users of our website, reservation service, and other online products and services (collectively, the “Services”). It also describes the choices available to you regarding our use of your Personal Information and how you can access and update this information. This Policy is incorporated by reference to the Terms and Conditions located at https://www.lumimnesquedance.com/terms, and forms an integral part of it.
When you sign up with Luminesque use our Services, you are agreeing to this Privacy Policy and the Terms and Conditions. By providing Personal Information (as defined below), you consent to the use of your Personal Information as described in this Privacy Policy. If you do not agree with the terms of this Privacy Policy, do not provide any Personal Information to us.
1. Introduction
We respect and uphold individual rights to privacy and the protection of Personal Information. We know how important it is to protect your Personal Information and want to make every customer experience safe and secure. In keeping with that goal, we have developed this Policy to explain our practices for the collection, use, and disclosure of your Personal Information.
For the purposes of this Policy, “Personal Information” means information about an identifiable individual, including, for example, an individual’s name, home address, telephone number, social insurance number, sex, income and family status. Personal Information does not include information that would enable an individual to be contacted at a place of business, for example an employee’s name, position or title, business telephone number, or business address. We will only collect, use or disclose Personal Information in accordance with this Policy, or in accordance with laws applicable to the collection, use and disclosure of your Personal Information by us (“Applicable Privacy Laws”).
2. Collection and Use of Personal Information
We collect two types of information through our Services (Personal Information and non-Personal Information), depending on the nature of your interaction with us.
a. Personal Information
We may collect the following Personal Information from you:
Contact Information such as name, email address, mailing address, phone number;
Billing Information such as credit card number, and billing address;
Unique Identifiers such as user name, account number, password;
User Content generated by you, such as audio, video, text and images as provided by you on our Services; and
Personal Information such as order or class reservation history and marketing preferences.
b. Non-Personal Information
We also automatically gather non-Personal Information about your device such as your IP address, browser type, referring/exit pages, operating system, as well as which aspects of our performance metric indicators available with our technology or our licensee’s products you prefer using.
c. Location Information
We do not use or collect your precise geographic location. We may derive your approximate location from your IP address in order to facilitate certain services such as determining the closest studio to you.
3. Use of Personal Information
We may use your Personal Information, in combination with your non-Personal Information, for a variety of business purposes, for example to:
fulfill your class reservation or order;
send you a class reservation or order confirmation;
send you requested service information;
send new class or schedule information;
respond to customer service requests;
administer your account;
send you a newsletter;
carry out contests or promotions;
send you marketing communications;
respond to your questions and concerns;
improve our Services and marketing efforts;
conduct research and analysis; and
for other purposes as described in this Policy.
4. Your Consent
We will collect, use, or disclose your Personal Information only with your knowledge and consent, except where required or permitted by Applicable Privacy Laws. When you choose to provide us with your Personal Information you consent to the use of your Personal Information as identified in this Policy and as may be further identified at the time of collection.
a. Express Consent
Sometimes you will be asked to give your express consent to our collection, use or disclosure of Personal Information – for example, by being asked to check a box to indicate your consent to receive marketing communications. We note that emails that are considered a part of an on-going relationship (including sending emails regarding your account with us, class reservations, or responding to your emails regarding the same) do not require express consent. Registered users may receive email communication from us directly relating to their experience in the studio, for example to follow up on a waiver or a credit card payment.
b. Implied Consent
Other times, you may provide your implied consent to our collection, use or disclosure of Personal Information when we can reasonably conclude that you have given consent by some action you have taken or an action you have decided not to take. Generally, this occurs where the purpose for the use of your Personal Information would be reasonably apparent to you – for example, when you provide us with your address or other Personal Information on your waiver or as part of your registration process for your Lagree West account when you sign up for classes.
c. Withdrawing Your Consent
You may notify us at any time that you wish to withdraw or change your consent to our use and disclosure or your information. We will accommodate your request subject to legal and contractual restrictions. If you have "opted in" or subscribed to one of our mailing lists, we will always provide you the opportunity to "opt out" or unsubscribe. For example, if you receive emails from us, we will provide a link in the email which you can use to unsubscribe from that mailing list, or you may contact us at glow@luminesquedance.com. You may also sign into your account at any time to see the Personal Information we have stored on your account. You may choose not to provide us with your Personal Information. However, if you make this choice we may not be able to provide you with the Services, or information that you requested.
5. Information Obtained from Third Parties
If you provide us with Personal Information about others, or if others give us your Personal Information, we will only use that information for the specific reason for which it was provided to us.
6. Disclosure and Sharing of Your Information
We will share your Personal Information with third parties only in the ways that are described in this Policy. We will not sell your Personal Information to third parties.
We may provide your Personal Information to companies that provide services to help us with our business activities such as web hosting providers, payment processors or customer service agencies, for example, with mindbodyonline.com. These companies are authorized to use your Personal Information only as necessary to provide these services to us, and in a manner consistent with this Policy.
Some of these operations may result in Personal Information collected by us being stored or processed in other jurisdictions outside of British Columbia, including in the United States and, as a result, your Personal Information may be accessible to those foreign jurisdictions’ law enforcement and regulatory authorities, for example, in accordance with the USA PATRIOT Act and other applicable laws of the United States.
We may also disclose your Personal Information
as required by law such as to comply with a subpoena, or similar legal process,
when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request, or
to any other third party with your prior consent to do so.
We make your contact information available to other users that you transact with on this site to help complete the transaction.
7. Information We Collect Automatically
In some cases, we automatically collect certain information as outlined below.
a. Our Services
You do not need to create an account with Luminesque to take a look around. However, if you decide to purchase or schedule a class with us, then you must create an account. To create an account, you are required to provide us with certain information, including Personal Information. We use the information we collect from you to provide the Services. When using our Services, we may collect the Internet Protocol (IP) address of your computer or other device, the IP address of your Internet Service Provider, the date and time you access our Services, the Internet address of the website from which you linked directly to our Services, the operating system you are using, the sections of our Services you visit, the Services pages read and images viewed, and the content you download from the Services. This information is used for Service and system administration purposes, and to improve the Services.
b. Cookies
We use “cookies”, a technology that installs a small amount of information on a user’s device to permit our Services to recognize future visits using that device. Cookies enhance the convenience and use of the Services. For example, the information provided through cookies is used to recognize you as a previous user of the Service, to offer personalized content and information for your use, to track your activity on the Service, to respond to your needs, and to otherwise facilitate your Service experience. You may choose to decline cookies if your browser permits, but doing so may affect your use of the Service and your ability to access certain features of the Service or engage in transactions through the Service.
c. Tracking Information
We may use web beacons or single-pixel gif tags to compile tracking information reports regarding Service user demographics, Service traffic patterns, Service purchases and other aggregated Service statistics, and may be used in our emails to determine which emails and links have been used by recipients. We may then provide these reports to advertisers and others. None of the tracking information in these reports can be connected to the identities or other Personal Information of individual users. For our own research purposes we may link tracking information with Personal Information voluntarily provided by Service users. Once such a link is made, all of the linked information is treated as Personal Information and will be used and disclosed only in accordance with this Policy.
d. Third Parties
Our Services may contain links to other websites or Internet resources, including mindbodyonline.com, which are provided solely for your convenience and information. When you click on one of those links you are contacting another website, mobile application or Internet resource and you are subject to their privacy policies. We have no responsibility or liability for, or control over, those other websites, mobile applications or Internet resources or their collection, use and disclosure of your Personal Information. We encourage you to read the privacy policies of those other websites to learn how they collect and use your Personal Information.
We may use a third party to gather information about how you and others use our Services. We do not allow advertising companies to collect data through our Service for ad targeting. Analytics companies may access anonymous data (such as your IP address or device ID) to help us understand how our services are used. They use this data solely on our behalf. They do not share it except in aggregate form; no data is shared as to any individual user.
This Privacy Policy applies to cookies placed on your device by us, but does not cover the use of cookies by any third-party advertisers. For the privacy practices of such third-party advertisers, you should consult the applicable privacy policy for the relevant third-party web advertiser(s).
8. Security of Personal Information
The security of your Personal Information is important to us. When you enter sensitive information (such as a credit card number) on our order forms, we encrypt the transmission of that information using secure socket layer technology (SSL). We follow generally accepted industry standards to protect the Personal Information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security.
9. Removal of Your Information
We may keep your information or data indefinitely, subject to your request for removal as outlined in this Privacy Policy.
10. Updates or Changes to Privacy Policy
We may update this Policy to reflect changes to our information practices. If we make any material changes we will notify you by email (sent to the email address specified in your account) or by posting a prominent notice on our website.
